According to the transcript, which Folha translated into Portuguese, the control tower in Sao Jose dos Campos authorized the Legacy before take-off to fly at 37,000 feet but made no mention of other altitudes foreseen in the original flight plan. Apparently unsure of what they heard, the pilots asked three times for clarification without getting a response.
The transcript, which was prepared by the National Transportation Safety Board in Washington, also shows that air traffic controllers in Brasilia mistakenly believed that the Legacy was flying at 36,000 feet.

They need to pay the Brazilian traffic controllers more, and controllers must speak clear fluent English!
I had a Brazilian tell me that pilots flying into Brazilian airspace should speak Portuguese. This is, of course impractical since the international language of aviation is English. I gave this person an example when I was in the military, on a flight crew. On ferrying our aircraft to Turkey, we had to fly through French,Italian, Greek and Turkish airspace. It would be really difficult to learn all of these languages. The controllers in these countries all spoke English that could easily be understood.
É mas…. não devemos nos esquecer que os pilotos do legacy não sabiam operar o avião direito, tanto é que esqueceram de ligar o transponder, que no caso, poderia ter evitado o acidente.

You say: It would be really difficult to learn all of these languages.
In the same case, to someone it is really difficult to learn english. :) Why do not to specify Portuguese as International Aviation Default Language? :D
