Para mim, são expressões equivalentes. Não vejo algo relevante para diferenciá-las.
Do Oxford:
Swear by somebody/something: to name somebody/something to show that you are making a serious promise.
Ex.: I swear by almighty God that I will tell the truth.
Do Macmillan:
Swear to God or swear on my life/the Bible etc. SPOKEN : used for emphasizing strongly that you are telling the truth.
Ex.: I swear to God I was never at that place.

As duas preposições estão corretas com "swear". Porém, para o seu exemplo específico, "to" e não "by", é a melhor opção. Neste caso diga "I swear to....".
