I chose DEFENDANT rather than PRISONER because that it probably closer to the writer's meaning. How is a prisoner going to pay anything if he is in prison/jail? A defendant, on the other hand, could be in custody or on probation/parole and fully employed and earning money. Of the three possibilities, I prefer the third.

Concordando com Thomas. Réu deve ser interpretado como "the defendant", ou "the accused". E "réu" nem precisa ser considerado como "detido", certo?

"o(a) requerido(a)"/"o(a) arguido(a) no processo.
Or still "impugnado" (depending on context).
